Liquidators are effectively the undertakers of the business world. Their primary role is to cash up all the assets and distribute the proceeds to persons owed money by the company and finally the shareholders.
Sometimes companies are liquidated without being insolvent because the company is no longer needed or there is a capital profit the shareholders wish to liberate without tax.
Companies can be liquidated by the company itself resolving to liquidate when it is either solvent or insolvent.
Other times a company is liquidated by Court order where a creditor applies to the High Court and if the application is granted either a liquidator nominated by the creditor or the Official Assignee is appointed.
Only certain persons can be appointed liquidator so my independence can assist.
There are coming changes to Insolvency laws that will impact on liquidations.
